Forks Collision Hospitalizes Three

A head-on collision near Forks, Washington Tuesday morning caused three occupants of one vehicle to be airlifted to Harborview Medical Center in Seattle.

The injured include Jacob P. Smith (9 months), Shanta R. Isham (24) and Dakotah J. Smith (26). The driver of the other vehicle, Percey O. Midtbo (76) was reportedly uninjured.

The State Patrol reports that the collision occurred when both vehicles crossed the centerline near milepost 7 on Highway 101.

Fault in a motor vehicle accident case in Washington is not necessarily an "all or nothing" proposition. Washington has adoped a "comparative fault" statute which provides that fault can be apportioned. This replaces the former rule that barred claims if the claimant was more than fifty percent at fault.
