Drunken Driver Crashes Car Repeatedly--Potential claims for Serving Customer Too Much Alcohol

After leaving the Muckleshoot Casino, a man, suspected to be intoxicated, caused a series of crashes in the early morning hours of September 27th.

The man hit a vehicle when exiting the Muckleshoot Casino parking lot and, shortly afterwards, hit a street sign while driving down a residential street.


According to a witness, the truck "flipped in the air, hit the telephone pole in the air and...rammed into the other two vans."

The drunken driver was taken to Auburn Regional Medical Center where he was treated and then released into police custody.

This series of accidents brings up two important issues. First, commercial establishments like Casinos are prohibited from serving people who appear to be intoxicated. If they serve someone who appears to be intoxicated they are liable to the people that customer hurts. Second, Indian tribes enjoy what's called sovereign immunity. That effectively means, in most situations, that they cannot be sued in state courts but that personal injury claims must be brought in tribal courts. There are some situations, however, where the Tribes' sovereign immunity is waived.
