      <title>A comment on Kearney Case Catalyzes Public Outrage About Hit and Run Collisions</title>
      <description>On June 27, 2009 my son was hit by a hit and run driver.  The driver who fled the scene was sober, driving with no insurance, and after he hit my son traveling 50 mph, he just kept right on going.  He hit my son so hard that his front bumper fell off.  (with his license plate so he was easy to locate after that)  He also totaled my son's car.  He has continued to drive...appearing in court, getting probation and being court ordered to pay a monthly restitution to my son.  He has not paid any restitution and has since, been charged with "reckless driving" and driving with no insurance in another jurisdiction.  My son miraculously managed to climb out of the wreckage through the passenger side door.   I will never forget the horror that night when I received the call, along with the sight of the wreckage.  I also say a prayer now, everytime my son leaves in my car.  Fear consumes me that was not there in the past.  There was no alcohol involved, nor was there a visibility issue.  Sometimes, people are just downright cruel and irresponsible. It is up to court officials to send a strong message that this will not be tolerated.  They can do this by being tough, using the hit and run driver as an example that this will not be tolerated and imposing maximum sentences.  I am thankful my son is alive.  If he keeps it up, this particular hit and run driver may kill someone one day.</description>

      <title>A comment on Bicycles and UIM Coverage...Why do I Need Auto Insurance if I Ride a Bike?</title>
      <description>Absolutely!&lt;br /&gt;&lt;br /&gt;While most cyclists own a car, there is a significant percentage of us who do not.&lt;br /&gt;&lt;br /&gt;As a non-car-owning cyclist, I currently have a rider on my homeowners policy to help protect me if I cause damage to someone's property while I am riding my bike, but at the moment I'm on my work-provided health insurance plan if I am hit by an un-insured motorist.  The protection shouldn't be expensive, it isn't *that* common, but I'd still like to have the option of purchasing that protection.&lt;br /&gt;&lt;br /&gt;...and a League of American Cyclists Road I class which teaches collision avoidance emergency stops and emergency turns could reduce the cost of that insurance.</description>

      <title>A comment on Medical Negligence in Port--Holland America May be Responsible</title>
      <description>I've always been puzzled by the logic of the body of law that says that "medical malpractice is a FORESEEABLE consequence of injuring someone" and making the index party liable for that. I cited an example in my June newsletter (&lt;a href="http://pilchermd.com/home/medical-malpractice-bulletin/2008/06/18/44/" rel="nofollow"&gt;More ... &lt;/a&gt;)on a case from Honolulu. How broadly does this concept apply? E.g., would a convicted assailant be liable for the malpractice of the physician treating his victim? Or even the malpractice of a specialty attorney to whom a general attorney referred a client?</description>

      <description>I am someone who heard about this terrible accident. I am also wondering about the children. The Olympian already posted the names of the parents of the surviving children. They are Karl and Marisa Bauducco Heiss. If you google their names you will find their business phone number. They are from Idaho.       <title>A comment on Tragedy in Thurston County--Marysville Redux for Cable Median Barriers?</title>
      <description>I was a witness to this accident and helped rescue the children and take care of the little boy. The subaru was in front of me. I'm still in shock on how this accident happened. It shouldn't of. The cable barrier didn't work for the subaru but it worked atferwards preventing the entangled semi and car from coming back over to the southbound lanes. I'm currently trying to find out how the children are doing. I still have the images in my head and going to be awhile before they leave. It was very bad accident.</description>
